  • Valid from 1 November 2026
  • Moore Multimedia · Vlaardingen

These terms apply to all work commissioned from Moore Multimedia: websites, webshops, branding, content, video, photography, animation, online marketing, Google Ads and AI solutions. We have written them to be as clear as possible. Have a question? Feel free to get in touch.

Definitions

  1. Moore: Moore Multimedia, based at Kreekweg 8 T, 3133AZ Vlaardingen.
  2. Client: the company or person who gives Moore an assignment.
  3. Assignment: the agreement between Moore and the client, as set out in the quote, the proposal or the confirmation by email.
  4. Work: everything Moore makes or delivers for the client, such as designs, websites, webshops, copy, photos, videos, animations, campaigns, software and AI solutions.
  5. Monthly package: an ongoing service that is invoiced per month, such as the Kickstart, Boost and Takeover marketing packages, the Google Ads packages, hosting and maintenance.
  6. In writing: on paper or by email.

When these terms apply

  1. These terms apply to all quotes, assignments and deliveries from Moore.
  2. The client's own terms do not apply, unless Moore agrees to them in writing.
  3. Does the quote say something different from these terms? Then the quote prevails.
  4. If part of these terms turns out to be invalid, the rest still applies. We will replace the invalid part with a rule that comes as close as possible to what was intended.

Quotes and assignments

  1. A quote is valid for 30 days, unless it states a different period.
  2. An assignment starts as soon as the client approves the quote in writing or digitally, or as soon as Moore starts work with the client's consent.
  3. Prices on the website, such as the package prices, are "from" prices. The quote always takes precedence.
  4. Obvious mistakes in a quote, such as a typo in an amount, do not bind Moore.

Delivery of the work

  1. Moore carries out every assignment to the best of its ability, with expertise and care.
  2. Moore promises effort, not results. We therefore do not guarantee any particular revenue, number of visitors, followers, enquiries or position in Google.
  3. Moore decides who carries out the work and may use regular partners or freelancers for it.
  4. Moore may carry out an assignment in phases and invoice per phase.

What we need from you

  1. The client provides all the information, copy, images, logins and access that Moore needs, on time.
  2. The client responds to questions and designs within a reasonable time, so that the schedule can be met.
  3. If something arrives late or is incorrect, and the project is delayed or takes more time as a result, Moore may adjust the schedule and charge for the extra hours.
  4. If a project stands still for more than 30 days because of the client, Moore may invoice the work done up to that point.

Schedule and deadlines

  1. A delivery date or schedule is a target date, not a hard deadline, unless we agree a fixed date in writing.
  2. If a deadline is at risk of being missed, Moore will let you know as soon as possible and we will make a new schedule together.
  3. A missed deadline does not entitle the client to compensation or to terminate the agreement, unless Moore still fails to deliver after a written reminder giving a reasonable period.

Changes and additional work

  1. If the client wants to add or change something that is not in the quote, that is additional work.
  2. Moore tells you in advance that something is additional work and roughly what it will cost. We only get started once you agree.
  3. Additional work is charged at the hourly rate in the quote. If no rate is stated there, our standard hourly rate applies.
  4. New landing pages, extra videos and complex technical integrations are not covered by a monthly package, unless the quote says so.

Prices and payment

  1. All prices are in euros and exclude VAT, unless stated otherwise.
  2. For projects such as a website, webshop or branding, Moore invoices 50% at the start and 50% on delivery, unless the quote says otherwise.
  3. Monthly packages are invoiced in advance at the start of each month. One-off setup costs are invoiced at the start.
  4. The payment term is 14 days from the invoice date.
  5. If payment has not been made after that term, the client is in default without any further reminder. Moore may then charge statutory commercial interest and collection costs in accordance with the law.
  6. Moore may adjust its rates for inflation once a year. We announce any other price increase at least 30 days in advance. The client may then cancel a monthly package as of the date the increase takes effect.
  7. The client reports complaints about an invoice in writing within 14 days. A complaint does not entitle the client to delay payment.

Monthly packages

  1. A monthly package has a minimum term of 3 months, unless the quote says otherwise.
  2. After the minimum term, the package continues month by month. It can then be cancelled at any time with a notice period of 1 month.
  3. You cancel in writing.
  4. What is included in a package, such as shoot days, reels and posts, applies per month. Anything not used in a month because of the client does not carry over to the next month, unless we agree otherwise together.
  5. A package can be upgraded as of the first day of the next month. A lower package can start after the minimum term has ended.

Ads and budget

  1. The advertising budget for Google, Meta (Facebook and Instagram) and other platforms is not included in Moore's price. The client pays this budget directly to the platform, unless we agree otherwise.
  2. Advertising accounts are in the client's name. Moore gets access as an administrator. When the collaboration ends, the client keeps their accounts and data.
  3. Platforms set their own rules, prices and decide whether an ad is approved. Moore is not liable for rejected ads, blocked accounts or changes made by a platform.
  4. Results such as clicks, enquiries, ROAS or CPA are not guaranteed. Moore does actively adjust and optimise to get the best result.

Photo, video and shoot days

  1. A shoot day or shoot can be rescheduled free of charge up to 5 working days in advance.
  2. If the client reschedules or cancels within 5 working days, we charge 50% of the day rate. Within 48 hours, that is 100%. Costs already incurred, such as location hire or crew, are always charged.
  3. If an outdoor shoot cannot go ahead because of bad weather, we will agree a new date with you free of charge.
  4. The client arranges permission from the people who appear on camera and permission to film at the location, unless Moore arranges this.
  5. Moore delivers the edited final versions. We do not supply raw footage and working files, unless we agree otherwise. Moore keeps raw footage for a maximum of 3 months after delivery.

Delivery and approval

  1. For designs, copy and videos, 2 rounds of revisions are included, unless the quote says otherwise. Extra rounds are additional work.
  2. After delivery, the client has 10 working days to check the work and report any errors in writing.
  3. The work is deemed approved if the client reports nothing within that period, or if the work is put into use. A website that goes live is therefore deemed approved.
  4. Minor flaws that do not get in the way of use are no reason to withhold approval or payment. Moore will fix them as soon as possible.

Hosting, maintenance and domains

  1. If Moore arranges the hosting, maintenance or domain name, that is a monthly package or annual service with a term of 12 months. It is renewed for a further 12 months each time, unless the client cancels in writing at least 1 month before the end of the term.
  2. Moore uses reliable partners for hosting. Moore makes regular backups, but cannot guarantee that a website will always be available without interruption.
  3. A domain name is registered in the client's name, unless we agree otherwise.
  4. Maintenance covers updates and security for the website. New features or major changes are not included.
  5. If hosting with Moore ends, we will help move the website to another provider. We charge the hours for this at our hourly rate, and only once all invoices have been paid.

Non-payment: suspension and taking offline

  1. If the client does not pay an invoice on time, Moore sends a written reminder with a final payment term of 14 days.
  2. If payment has still not been made after that final term, Moore may, after written notice, suspend all of its work and services until everything has been paid. This applies to all of the client's current assignments.
  3. Suspension means, among other things, that Moore may:
    • temporarily take the website or webshop offline or display a notice;
    • temporarily stop hosting, email and other services provided through Moore;
    • pause advertising campaigns and halt the management of social media;
    • withhold work not yet delivered, files, logins and ownership rights.
  4. During that period the client remains liable for the agreed amounts, including those for monthly packages.
  5. Moore is not liable for damage or loss of revenue caused by work or services being suspended.
  6. After full payment, Moore will switch everything back on as soon as possible. Moore may charge a fee of € 95 excl. VAT for switching things back on.
  7. If payment has still not been made 60 days after the final payment term, Moore may terminate the assignment. Moore may then delete the website and the related data, after a final written warning of 14 days.

Ownership and rights

  1. All rights to the work, such as copyright, remain with Moore until the client has paid everything they owe Moore.
  2. After full payment, the rights to the final work made specifically for the client, such as a logo, brand identity, design and the delivered content, pass to the client. The client may then use a website design, photos and videos without restriction for their own business.
  3. What Moore already had or what is in general use remains the property of Moore or of the original creator. Think of our own code, templates, working methods, themes, plugins, fonts, stock images and music. For these, the client receives a right of use, under the creator's terms.
  4. Sketches, designs that were not chosen, raw footage and working files remain with Moore, unless we agree otherwise.

Portfolio

  1. Moore may show the work on its own website, on social media and in presentations, naming the client.
  2. Moore may place a small credit in the footer of a delivered website, such as "Website by Moore".
  3. Does the client not want this, for example for confidentiality reasons? Let us know in writing and we will respect that.

Your material

  1. The client guarantees that they are allowed to use the copy, images, logos and other materials they supply.
  2. If Moore receives a claim from someone else because supplied material infringes their rights, the client takes over that claim and its costs.
  3. The client is responsible for the content of their own website and communications, such as prices, terms, claims and the cookie notice, unless Moore wrote that content itself at the client's request.

AI and third-party software

  1. Moore may use AI tools to work faster and better, for example for ideas, copy, images or code. A person at Moore always checks the end result.
  2. We do not enter the client's confidential data into public AI tools without permission.
  3. With custom AI solutions, such as chatbots and automations, the output can sometimes be wrong. The client checks important output themselves and remains responsible for decisions made on the basis of it.
  4. Does the work use services from other parties, such as OpenAI, Shopify, WordPress plugins or payment providers? Then their terms apply too. The costs of these services are for the client, unless they are included in the quote. Moore is not liable for outages or changes at these parties.

Liability

  1. Moore is only liable for direct damage that results from a mistake by Moore.
  2. Moore is not liable for indirect damage, such as lost revenue or profit, lost data, reputational damage or business interruption.
  3. Liability is limited to the amount the client has paid for the assignment. For monthly packages, that is at most the amount for the last 3 months. In all cases, liability is never higher than the amount paid out by Moore's insurance.
  4. The client reports damage as soon as possible and no later than 12 months after discovering it.
  5. These limitations do not apply in the case of intent or gross negligence on the part of Moore.

Force majeure

  1. If Moore is temporarily unable to meet its commitments because of force majeure, those commitments are postponed. Think of illness, outages at hosting or internet providers, cyberattacks, outages at platforms such as Google or Meta, or extreme weather.
  2. If the force majeure lasts longer than 60 days, either party may terminate the assignment in writing. What has already been delivered is paid for proportionally.

Confidentiality and privacy

  1. Moore and the client keep each other's confidential information secret, including after the collaboration has ended.
  2. If Moore processes personal data for the client, for example customer data in a webshop or newsletter, we will conclude a data processing agreement for it in accordance with the GDPR.
  3. How Moore itself handles personal data is set out in our privacy statement.

Cancellation and termination

  1. The client may stop a project, such as a website, partway through. They then pay for the work already done, the costs incurred and 25% of the remaining amount of the quote.
  2. Moore may terminate an assignment immediately if the client goes bankrupt, applies for a suspension of payments or ceases trading.
  3. When the collaboration ends, and after full payment, Moore hands over the files and logins the client is entitled to.

Hiring staff

  1. During the collaboration and for 12 months afterwards, the client will not employ Moore's staff or regular freelancers, or engage them directly, unless Moore agrees in writing.

Law and disputes

  1. Dutch law applies to all agreements with Moore.
  2. If we disagree, we will first try to resolve it together.
  3. If that does not work, the competent judge of the District Court of Rotterdam decides.
  4. Moore may change these terms. A new version takes effect 30 days after we have notified you of it. For projects in progress, the version that applied at the start continues to apply.
